Carteira de Trabalho Digital: Understand What Changes
The mandatory document used to register employees in any economic or domestic activity, the Employment and Social Security booklet (Carteira de Trabalho e Previdência Social - “CTPS”) has received an electronic version called Carteira de Trabalho Digital (Electronic CTPS).
The Law 13874 of September 20, 2019, the so-called Law of Declaration of Economic Freedom Rights, created the Electronic CTPS and the SEPRT Ordinance 1065, of September 23, 2019, governs the issuance method.
Electronic CTPS enabled by citizen
The digital document is previously issued to all Brazilians and foreign citizens registered with the CPF. However, each worker will have to enable the electronic mode by creating an access account at www.gov.br/trabalho.
It will be enabled at the first access, and may also be done by the application "Carteira de Trabalho Digital", freely available for mobile devices.
Electronic CTPS and eSocial
The companies required to provide information to eSocial can now hire employees without requiring them to have a physical document, and as all data in CTPS are those that must be reported to the system, the employer is exempt from notation in the booklet.
The company must observe the deadline to send the employee's hiring information to eSocial and it is possible to see the employment agreement in the Electronic CTPS forty-eight (48) hours after the information is sent by the employer and, in case of divergence, the employee can already request the company's adjustment.
It is also necessary to take into account the processing time between the receipt of information in eSocial and its availability in the Electronic CTPS system.
While Electronic CTPS simplifies the entrepreneur's routine, on the other, it makes easier for government systems the verification and crosschecking of labor and social security data.
Physical CTPS can still be used
Anyone hired by an employer not yet required to report to eSocial will still need the physical card.
Anyway, the government guides that every citizen keep the CTPS in physical format, because it remains a document to prove the previous working time, especially very old records.
Electronic CTPS nowadays
For Leonardo Bezerra, DPC’s Labor and Social Security manager, the change can be a breakthrough, which will ensure greater dynamism and less flow of documents in companies. "It seems that there will be an optimization in this process, ending in the medium or long term with the circulation of the physical CTPS and the current manual updates," says the expert.
The access to the Electronic CTPS is still unstable and flawed. A warning is issued by the system informing the citizen that possible errors will be remedied. The user himself can indicate inaccuracies or omissions through the platform.
“As employees have access to and experience inconsistencies, many questions about the settlement of labor information in the document will arise.”
