Accident Prevention Factor (FAP) for 2022 will be released on September 30

Published in the Federal Official Journal on September 21, Ordinance MTE/ME No. 02 establishes that the Ministry of Labor and Social Security will make available on September 30:

• The lists of percentiles of frequency, severity and cost, for each Subclass of the National Classification of Economic Activities (Classificação Nacional de Atividades Econômicas - CNAE), calculated in 2021, considering information from the social security database for the years 2019 and 2020.
• The Accident Prevention Factor (Fator Acidentário de Prevenção - FAP) calculated in 2021 and in force for the year 2022, together with the respective orders of frequency, severity, cost and other elements that enable the business (full CNPJ) to verify its performance within its CNAE Subclass.

Once disclosed, the information can be accessed at the electronic addresses: https://www.gov.br/previdencia and https://www.gov.br/receitafederal.

FAP may be challenged before the Social Security Appeals Council through a form that will be made available on the aforementioned websites.

Understand FAP

FAP varies annually and is calculated by business. Companies that register more occupational accidents or illnesses pay more. Also according to the methodology, FAP increases the bonus for companies that record less accidents. In cases where there is no occupational accidents, the company receives a 50% reduction in the rate.
