Employers must supply racial and ethnic data of workers in labor registers and documents
Companies must implement the new standard right away to remain in good standing
Published on April 24, Law No. 14,553/2023 has amended the Racial Equality Act with important effects in the labor front.
From now on, government authorities and employers from private entities will both be required to include a field dedicated to the racial and ethnic identification of their employees, which must be filled out according to self-classification criteria.
Pursuant to the law, the following documents must meet the new standard, which may be extended to other documents of similar nature:
- Job application and termination forms;
- Workplace accident report forms;
- Registration documents filed with the National Employment System (Sine) or with other registry of similar purpose;
- Annual Social Information Report (Rais), or other document created in the future with similar content and purposes;
- Documents, including those available in digital media, intended for the enrollment of insured workers and their dependents with the General Social Security Scheme (RGPS);
- Questionnaires from surveys carried out by the Brazilian Institute of Geography and Statistics Foundation (IBGE), or by any government authority created in the future with the same attributions.
Such information shall be included in order to gather statistical data for the implementation of public policies aimed at fostering racial equity, as the IBGE will carry out a survey every five years to assess the employment rates by race and ethnicity.
Companies should be mindful of this new requirement because the law is already in force, as of its publication date (04/24/2023).
