Pay transparency report must be filled out by February 29
Companies with 100 or more employees should be mindful of new requirement
The Ministry of Labor and Employment (MTE) has announced the deadline for filling in, on a tentative basis, the first biannual pay transparency report. The document must be filled in on the Emprega Brasil portal from January 22 to February 29.
This reporting obligation applies to companies with 100 or more employees. Data on salaries and occupations that have already been supplied via eSocial will be utilized. Employers are also required to supply additional information on remuneration criteria and efforts supporting the hiring and promotion of women within their workforce.
Set forth in Law No. 14,611/2023, this requirement enables the government to assess salary discrepancies among male and female employees that occupy the same positions.
In addition to filing in the report every six months, companies are also required to disclose the document every March and September on its websites, social networks, or similar platforms to ensure broad dissemination.
Fines for non-compliance
In the event of non-compliance with completing and disclosing the report, the law provides for an administrative fine of up to 3% of the employer's payroll, limited to 100 minimum wages.
In addition, other penalties are also enforceable, such as compensation for moral damages in cases of discrimination based on gender, race, ethnicity, origin or age.
