The Emergency Program for Employment Maintenance (BEm) came to an end on August 25, day in which companies must end the working hours and salary reduction agreements or the suspension of employment contracts.

Therefore, the “normal” working hours and wages agreed before this temporary change in the employment relationship must be resumed.

Employers must be aware of the right to job security rule for employees who had their contract suspended or salary reduced for the same period in which there contract suspension or salary reduction – except in cases of dismissal with cause .

According to Provisional Measure 1045, of April 27, 2021, BEm had established a duration of 120 days. The program benefited more than 630 thousand employers and 2.5 million workers, as shown by the public panel of the Ministry of Labor and Social Security.

The measure may still become valid again. A substitute text of the provisional measure was approved by the Chamber of Deputies and sent to the Senate, where it still needs to be analyzed.
