Census of Foreign Capitals in Brazil: deadline report the obligation to Bacen ends in August
The deadline to report the Annual Census of Foreign Capital in Brazil is open, which will end at 6 pm on August 17, 2020.
The Central Bank of Brazil (Bacen) established rules that regulate the Five-Year and Annual Census of foreign capital in Brazil. The Five-Year Census is considered to refer to the base dates of years ending in zero (0) or five (5), while the Annual Census refers to the base dates of the other years, always remembering that the Census reports will have December 31 of the previous year as base date.
The Bacen conducts these census modalities to gather statistics from the foreign sector. These data help in the composition of surveys and in definition of economic policies.
In 2020, the Annual Census report for the base year 2019, with reference date December 31, 2019, must be filed.
Important: Failure to report, reporting after the legal deadline, or providing incomplete or inaccurate information may result in the application of penalties by the Bacen.
Annual Census
Refers to the base dates of the years not ending at zero (0) or five (5), i.e. the years in which the Five-Year Census does not take place. Thus, the companies required to report on the Annual Census are the:
- Legal entities headquartered in the brazil with direct interest of non-residents in its capital share, in any amount, and with equity equal to or greater than the equivalent of USD 100 million on the base date of December 31 of the base year;
- Investment funds with non-resident shareholders and with equity equal to or greater than the equivalent to USD 100 million, on the base date of December 31 of the base year, through their managers; and
- Legal entities headquartered in Brazil, with a total debit balance of short-term commercial credits (payable within 360 days) granted by non-residents, amounting to or greater than the equivalent of USD 10 million, on the base date of December 31 of the base year.
