Companies with Internal Health and Safety Commissions must implement measures to prevent and curb sexual harassment

Employers required to have an Internal Commission for the Prevention of Accidents and Harassment (CIPA) must be mindful of the new provisions set forth under Ordinance No. 4,219/2022.

The new rules will enter into force as of March 20, 2023, and companies must comply with their requirements, which include the implementation of measures aimed at preventing and curbing sexual harassment and other forms of violence in the workplace.

Check out below the new provisions surrounding the topic:

• The company’s internal policies must incorporate rules of conduct regarding sexual harassment and other forms of violence, and their contents must be fully disclosed to all employees, regardless of gender;
• Procedures must be put in place for receiving and following up on complaints, in order to investigate incidents and apply disciplinary sanctions to those guilty of perpetrating sexual harassment or acts of violence, ensuring the anonymity of the complainant, without prejudice to other applicable legal sanctions.
• At least every 12 months, employers must carry out training procedures, issue instructions and promote awareness-raising actions aimed at all employees, regardless of gender, at all levels of the company’s hierarchy, on topics related to violence, harassment, equality and diversity in the workplace, by means deemed accessible, appropriate and effective.

Companies are required to comply with the new rules and should keep a close eye to other labor and social security regulations in order to avoid potential fines and penalties.
