INSS: companies can now query benefits requested by employees

The National Social Security Institute of Brazil – INSS has published the DIRBEN/INSS Ordinance No. 1,012/2022, which addresses the access of companies to administrative decisions regarding social security benefits requested by employees.

CAs stated in the act, the goal is for employers to be aware of the results of their workers’ applications related to workplace disabilities and/or accidents, as well as the occurrence of events that may affect the employment relationship.

The benefits that can be queried are as follows:

The information available concerns the dates of application, approval, start, and cessation of the benefits, as well as their status at the time of the query.

According to the INSS, information that is deemed private will still be kept confidential.

The access to this information was already allowed in some form, but for a shorter period. Now, data will be available for 18 months, starting from the date the benefit is granted.

The use of insured employees' data for purposes other than those established in the ordinance will result in the company being held responsible.

 The query can be made on the INSS website under the options of services for companies. To access it, it is necessary to be registered at the federal Revenue Service.
