Law establishes certification for companies that support mental health

Companies that foster employee wellness and mental health can be accredited as Mental Health-Friendly Companies by the federal government
Law No. 14,831/2024 was enacted on March 28 in Brazil. The act provides for the creation of the Certificate for Mental Health-Friendly Companies and sets the criteria for awarding this certification.
According to the legislation, the certification will be valid for two years and will be issued by a certifying commission appointed by the federal government. As per the regulations, this commission will be responsible for evaluating whether the practices implemented by the company align with the law's guidelines to promote the mental health of its employees.
Guidelines for certification
The law specifies that, in order to be granted certification, companies must put actions and policies in place based on three guiding principles:
Mental health support
- Implementation of mental health support programs in the workplace;
- Provision of access to psychological and psychiatric support resources for employees;
- Promotion of mental health awareness through campaigns and training;
- Awareness of women’s mental health;
- Leadership training programs;
- Specific training courses on mental health issues of particular interest to employees;
- Measures against all forms of discrimination and harassment;
- Regular evaluation and adjustment of implemented actions;
Employee wellness
- Safe and healthy workplace;
- Work-life balance policies;
- Promotion of physical and leisure activities;
- Promotion of healthy eating;
- Healthy interaction in the workplace;
- Integrative communication;
Transparency and accountability
- Regular disclosure of actions and policies related to promoting the mental health and well-being of employees through company-used media;
- Maintenance of a channel for receiving suggestions and evaluations;
- Goal-setting and periodic analysis of results related to the implementation of mental health support policies.
Disclosure of actions
The law allows employers to display their certification in their corporate communications as a means to underscore their commitment to the mental health and wellness of their employees.
