Ordinance introduces new provisions on workplace inspection, public policies and labor relations
With the publication of Ordinance No. 1,486/2022, on June 6, the Department of Labor and Social Security (MTP) changed several labor-related provisions.
Amendments have been made to aspects related to employment contracts, information entered by employers in their workers’ social-security cards (CTPS) and electronic control of working hours. New provisions also include requests for unionization and changes to the Statutes of companies undergoing merger or amalgamation.
Employers need to be wary of changes made to time and attendance regulations, especially when implemented electronically, as electronic clocking-in systems have all been grouped together as variations of the REP format (Electronic Clocking-in Registration). Attention should also be paid to amendments made to the CAdES and PAdES electronic signature standards and to the record of signatures generated through recordkeeping systems.
To protect themselves against tax audits, companies must also keep in mind the changes made to the preparation of the Source Data File (AFD) and the Working-time Electronic File (AFJ), which must now follow the requirements set by the gov.br website.
