Rio de Janeiro City Hall rules the “Concilia Rio” Program

Through the publication the Decrees 43320 and 43321 at the Official Gazette of Municipality of Rio de Janeiro, the City Hall ruled the return of the “Concilia Rio” Program, which allows the settlient or installment payment of tax and nontax debts enrolled in active debt with decrease in default charges and ex officio penalties.

Covered debts

1. Tax on Services of any kind (ISS), unless subject to the Simples Nacional systi (foreseen in Complientary Law No. 123/2006);

2. Tax on Building and Land Urban Property (property tax);

3. Tax on Domestic Garbage Collection (TCL); and

4. Tax on Transfer of Real Estate and Rights relating thereto, held inter vivos, chargeable (ITBI).

The “Concilia Rio” Program will cover the triggering events occurred until Dec-31-2016, and joining is by completing administrative application filed in one of the Prosecutor's Active Debt of Municipality service stations.

Duration

Taxpayers will have ninety-days-period as of Jul-07-2017 to join the program. This period shall not be extended, and may be extended only when the application for joining has not a conclusive analysis within the program deadline, or in cases where the issuance of a payment slip or installment require diligences in order to identify the exact amount the taxpayer owes and the achieved tax benefits.

Exclusion

For cases where the payment of any portion is interrupted or have a delay over than thirty days from maturity, the benefits may be cancelled, regardless the notice, with the consequent recalculation of debt and continuation of collection, the possibility of new application after the deadline of the program duration is forbidden.
