Pregnant women must go back to work at the office
Return to working at the office in person is conditioned to the complete protection against Covid-19
Published on March 10, Law No. 14,311/2022 amends the rules for pregnant employees, including domestic workers, to be cleared of their work activities during the pandemic.
Until then, pregnant women should necessarily be removed from on-site work by employers, with no loss of salary. Now, companies may mandate these employees to return to on-site working on the following occasions:
- after the termination of the declared state of public health emergency;
- after their complete immunization (in accordance with definitions by the Ministry of Health);
- through exercising their legitimate individual choice for non-vaccination as long as accompanied by a term of responsibility.
Removal from on-site working is now only in place for women who are yet to be completely immunized against the pathological agent.
Per internal definitions, the company may opt for keeping these employees working remotely, permanently, provisionally or in any other type of arrangement for off-site work without decrease in compensation.
