Quarterly DEF: Last statement of the year must be submitted by 12/31.

Companies receiving foreign direct investment in total assets of equal to or greater than BRL 300 million must pay attention to the Central Bank's (Bacen) schedule for the quarterly submission of the Economic-Financial Statement (DEF). This is because the final deadline for submitting the year's last statement, based on the 09/30 reference date, ends on 12/31.

The deadline for submitting the declaration has been effective since November 11. The declaration must be made using a specific functionality in the new version of the Foreign Capital Reporting System for Foreign Direct Investment (SCE-IED), which was implemented in October 2024.

What needs to be included in the DEF

Some of the items that must be part of the quarterly statement are: paid-in capital, equity, estimated company value, valuation method, among others.

Fines and Penalties

There are fines for submitting information after the deadline, incorrectly, incompletely, failing to submit, or providing false information. The statement is mandatory, and companies that fail to comply may face fines of up to BRL 250,000.

 It is worth noting that the Central Bank can suspend the recipient's FDI (Foreign Direct Investment) operation in case of non-compliance with the regulations. As a result, it will not be possible to settle foreign exchange transactions linked to the SCE-FDI Code, either for inflows or remittances.
