STF maintains the end of the compulsory union contribution

The Federal Supreme Court (Supremo Tribunal Federal - “STF”) confirmed on Jun-29-2018 the end of the obligation to pay the Union Contribution in the judgment of the Direct Unconstitutionality Actions (Ações Diretas de Inconstitucionalidade - “ADI”), which questioned the changes in contribution brought by the Labor Reform.

The subject was questioned in ADI No. 5794, in 18 other ADI filed against the new rule and in the Declaratory Action of Constitutionality (Ação Declaratória de Constitucionalidade - “ADC”) No. 55, which sought recognition to the validity of the change in legislation. As they were in joint action proceedings, the decision applies to all cases.

Per six votes against three, STF maintained the new legislation on the Trade Union Contribution, prevailing the optional payment position, and companies discount the employees depending on the employee’s express authorization.
