The deadline to file the Statement of Brazilian Capital Abroad (CBE) for the first quarter of 2019 is open
The period to file the Quarterly Statement of Brazilian Capitals Abroad (quarterly CBE), which is mandatory for individuals and legal entities resident, domiciled or headquartered in Brazil, holding assets (assets and rights) against non-residents, including real estate, deposits, available in foreign currency, among other assets, whose sum total amounts equal to or greater than USD 100,000,000.00 or equivalent in other currencies, at the base dates of March 31, June 30 and September 30 of each year.
The quarterly CBE of goods and rights abroad comprises information related to the following modalities:
I - deposit;
II - currency loan;
III - financing;
IV - financial leasing;
V - direct investment;
VI - portfolio investment;
VII - application in derivative financial instruments;
VIII - other investments, including real estate and other assets.
Filing Deadline
For the amounts referring to the quarter ended March 31, 2019, the deadline to file the statement is from April 30 by the 06:00p.m. of June 6, 2019.
Penalties
Failure to comply with the standards subject those responsible to penalties in accordance with the percentages set forth below, due to the following occurrences:
Register or file a statement after the deadline: one percent (1%) of the amount subject to registration or report, limited to BRL 25,000.00. From 1 to 30 days after the deadline, the penalty will be reduced to 10% of that value. From 31 to 60 days after the deadline, its reduction shall be to 50%.
Provide inaccurate or incomplete information: two percent (2%) of the amount subject to registration or report, limited to BRL 50,000.00.
Fail to record, fail to present a statement, or fail to present information supporting documents provided to Bacen: five percent (5%) of the amount subject to registration or statement, limited to BRL 125,000.00.
Provision of false information in registration or declaration: 10% (ten percent) of the amount subject to registration or statement, limited to BRL 250,000.00.
Note:
For the aforementioned occurrences 1, 2 and 3 above, the fine may be increased in 50% if the responsible person does not provide, does not correct, or does not complement the record or statement when requested by the Bank.
The deadline for collecting the penalty for late CBE report is five years from the end of the regulatory deadline for each statement.
