Changes in the General Law of Protection of Personal Data was approved

The Provisional Measure 869/2018, which amended the Law 13709/2018, hereinafter referred to as the General Law on Personal Data Protection (LGPD), was amended by Law 13,853/2019, with amendments.

The Law 13.853/2019, published on Jul-09-2019, provides, among other measures, on the protection of personal data and creates the National Data Protection Authority (Autoridade Nacional de Proteção de Dados - “ANPD”). In addition, it is determined that its rules are of national interest and must be observed by the Union, States, Municipalities and Federal District.

The ANPD is temporary in nature and may be transformed into an agency under the Presidency of the Republic, within two (2) years from the date the regulatory structure of the ANPD enters into force, at the Government's discretion.

Another important issue in the standard is that the ANPD may request, at any time, the agencies and entities of the public power to carry out operations using personal data, specific information about the scope and nature of the data and other details and may issue supplementary technical opinion to ensure compliance with the law in question.
